Conditions Of Sale
In order to make bids, all bidders must fill in a Paddle Registration Form at the Registration Desk before the start of the live auction. Keep in mind that all artworks are subject to a reserve bid, a confidential amount that must be met for the lot to be sold. If your bid is successful, you must go to the Payment Desk before the end of the evening to pay by cash, Interac or by credit card. Title to the offered lot will then pass to you, and you will thereupon assume full risk and responsibility for the work purchased by you. If you are unable to pay at the conclusion of the auction, ACCM reserves the right to offer the art to the previous bidder if they are able to pay for it.
In the event of any dispute between bidders, a missed bid or doubt as to the validity of any bid, the auctioneer will have, at his discretion, the final authority either to determine the successful bidder or to re-offer and resell the work in dispute.
If any dispute arises after the auction, the Artsida record of the auction proceedings shall be conclusive.
General Rules For Live Auction
All sales are final. No purchase can be returned, refunded or exchanged. All property is sold as is, as exhibited. If the final purchase price is equal to or greater than 120% of the estimated value, the purchaser will be issued a charitable tax receipt for the difference between the estimate and the selling price.
Successful bidders should be prepared to pay for their purchases with cash, Master Card, or Visa on the evening of the auction. No GST, QST or auction commission is applicable.
Artsida reserves the right to withdraw any work of art at any time before the actual sale.
ACCM makes no warranties or representation of any kind or nature with respect to any work of art including, but not limited to, any representation or warranty of description, genuineness, attribution, provenance, or physical condition, nor as to the right of reproduction, if any. Bidders and purchasers may not rely upon any statement, oral or otherwise, other than that set forth in these conditions of sale.
All works must be paid for at the conclusion of the auction evening. Purchasers must pick up works at the conclusion of the auction evening upon proof of payment. Transportation may be arranged, at the purchaser’s expense. ACCM is not responsible for acts or omissions of carriers or packers of purchased lots, whether or not recommended by ACCM. Packing and handling of purchased lots are at the entire risk of the purchaser.
If you live outside of Montreal or are unable to attend the event, absentee bids can be placed by filling out the Absentee Registration Form. All Absentee Registration Forms must be e-mailed to firstname.lastname@example.org before 11:59PM on Thursday March 9th, 2017. All bids will be accepted and executed, subject to the terms and conditions of sale.
In the event of identical bids, the earliest received bid will take precedence.
Successful bidders will be notified, and purchase will be charged to your MasterCard or Visa as indicated on your completed form.
